Welcome to TopTip.eu ! The following Terms and Conditions (GTC) set out the rules for using our services, including domain registration and web hosting.
Please read them carefully, as they form the legal basis of our business relationship.
For your convenience, this English version is provided as a translation. In case of discrepancies, the German version shall prevail.

These Terms are based on German law, including applicable EU consumer protection rules. The English version is provided for convenience; in case of discrepancies, the German version shall prevail.

1. Scope of Application

These General Terms and Conditions (GTC) govern all contracts concluded between the customer (“you”) and Galaxy GmbH (“we”, “us”) concerning the services offered on our website, including but not limited to domain registration, web hosting, and related services.

2. Governing Law, Jurisdiction & Contract Language

These GTC are subject to the laws of the Federal Republic of Germany, including applicable EU consumer protection regulations.
If you are a merchant within the meaning of the German Commercial Code, the place of jurisdiction is our registered office.
Mandatory consumer protection provisions of your habitual residence remain unaffected.
The contract language is German. This English version is a translation provided for convenience. In case of discrepancies, the German version shall prevail.

3. Definitions

  • Consumer: Any natural person who enters into a legal transaction for purposes predominantly outside their trade, business or profession.

  • Entrepreneur: A natural or legal person or a partnership with legal personality acting in the exercise of their trade, business or profession.

  • Services: Our hosting, domain and related offerings as described on the website.

4. Conclusion of Contract

By submitting an order (e.g., via our online form or email), you make a binding offer. The contract is concluded when we accept your offer by sending an order confirmation by email. We may refuse orders on objectively justified grounds.

5. Prices, Billing & Payment

  • Prices are shown on our website and are final prices including VAT where applicable, unless stated otherwise.

  • Payment is due in advance for the agreed term (e.g., annual or multi-year).

  • Invoices are provided electronically. You consent to receiving invoices by email.

  • If a payment is overdue, we may suspend services after prior notice.

6. Term, Renewal & Termination

  • Contracts are concluded for the selected term. Unless otherwise stated, they renew automatically for the same term if not cancelled in due time.

  • Ordinary termination is possible at any time to the end of the current term, subject to the notice period stated on the product page or invoice.

  • The right to terminate for cause remains unaffected.

7. Provision of Services

  • Services are provisioned after receipt of payment and any required domain holder data.

  • Reasonable maintenance windows and short-term restrictions may occur.

  • Third-party registries and providers may set additional conditions; these form part of the contract.

8. Customer Obligations & Acceptable Use

  • You must keep your access data confidential and use secure passwords.

  • You must comply with applicable law and refrain from abusive use.

  • You are responsible for backups of your content unless expressly included in the service.

  • You must keep your contact information up to date.

9. Domain Registration Terms

  • Domain registrations and renewals are performed in your name and on your behalf with the respective registry.

  • Once a domain is registered, it is generally non-refundable.

  • Transfers, updates, and cancellations are subject to registry rules and timeframes.

  • You must ensure that your chosen domain does not infringe third-party rights.

10. Right of Withdrawal (Consumers)

Consumers have a statutory right of withdrawal for service contracts as described in the Cancellation Policy below. The right may expire prematurely if the service has been fully performed with your prior express consent.

11. Warranty, Service Levels & Maintenance

  • We provide services with reasonable care and skill.

  • Planned maintenance will be announced where feasible.

  • For free or beta features, warranty and support may be limited.

12. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability laws. For simple negligence, we are liable only for breach of a material contractual duty, limited to the foreseeable damage typical for the contract.

13. Data Protection

We process personal data in accordance with the GDPR and German data protection laws. Details are provided in our Privacy Policy.

14. Changes to these Terms

We may adapt these GTC for valid reasons (e.g., legal changes, technical adjustments). Material changes will be communicated in advance.

15. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Cancellation Policy (Right of Withdrawal)

1. Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.

2. Withdrawal Period
The withdrawal period is 14 days from the day the contract is concluded.

3. Exercising Your Right
To exercise the right of withdrawal, you must inform us (Galaxy GmbH, Hohenzollernring 57, 50672 Cologne (Köln), Germany, Email: galaxy@toptip.net) of your decision to withdraw by a clear statement (e.g., by post or email).

4. Effects of Withdrawal
If you withdraw from this contract, we will reimburse you all payments received within 14 days. We will use the same means of payment you used, unless expressly agreed otherwise.

5. Premature Expiry / Exclusions
The right of withdrawal does not apply, or may expire prematurely, for service contracts after the service has been fully performed, provided performance began with your prior express consent and your acknowledgment that you would lose the right once the contract has been fully performed. This typically includes domain registrations and immediate activation of hosting services.
